Telephone Consumer Protection Act (TCPA)

The Telephone Consumer Protection Act (TCPA) was passed in 1991 with the goal of protecting consumers from solicitous phone calls and faxes from companies. The act regulates how and when these calls can be made and faxes sent.

Ban On Receiving Calls to Cell Phones

The TCPA prohibits debt collectors or creditors from using auto dialers to call cell phones unless you have provided them "express consent" to do so. Express consent is usually made in your original credit application and can be revoked any time in writing. You can tell a call is "auto dialed" if an artificial/prerecorded voice answers or leaves messages or if there is a delay between when you say hello and a voice answers on the other line.
