Evidence Attorney Review

  • Below are some of the evidence we’d like to see, depending on your situation. You can speed up your case review by providing as many of these documents as possible prior to our first communication. You can fax or email them in, upload them through our case tracker, or send them in by U.S. mail.
  • Please don’t write on or alter, or mail in, your original documents. If you want to make a notation on a document or send documents by mail, please make sure to use copies.
  • You may black out or conceal as much of your personal information (e.g., account info, SS#’s, etc.) as you want prior to sharing your documents with us. If you’ve covered up something we need to see we will let you know (again—don’t write on originals!).
  • Don’t worry if you don’t know have all these documents, we can uncover more details when we communicate after reviewing your initial inquiry.
Debt Collector Help

  • all written correspondence you have from or sent to the debt collector or creditor
  • any certified mail receipts that you have to show when the debt collector or creditor received your dispute
  • any phone records (or written phone logs) you have showing any calls from the collector or creditor
  • pictures of your caller ID showing the collection calls you have received
  • ANY AND ALL VOICE MAILS YOU RECEIVE, WE CAN RECORD THEM OVER THE PHONE AND THEY WILL HELP YOUR POTENTIAL CASE GREATLY (IMPORTANT: MAKE SURE TO SAVE ANY FUTURE VOICEMAILS)
  • a short description of what the debt is about (for example, a credit card account, a personal, payday or auto, paying a bill online or over the phone, enrolling for a monthly service (such as credit repair, video or gym membership, etc.
  • any related documents such as loan agreements, credit card agreements, documents which authorize automatic payments (including automatic bill pay), or billing statements for monthly services
  • any third party statements you can gather (for example, third parties like your employer, friends or neighbors who may have been contacted with regard to your debt or who witnessed any adverse reaction you had to being collected upon.
  • If your debt is a medical debt, any explanation of benefits (EOB) you’ve received.
  • any other relevant documents or information you feel you may have.
Collection call Help/Telephone Privacy Help

  • call logs showing the date, time and number displayed on your caller ID for all calls received, noting whether you were called at home, at work, or on your cell phone
    • Depending on your provider, you may be able to download previous phone bills.
    • You can also take pictures/screen shots of your caller ID.

  • Any letters you sent asking for calls to stop
  • any certified mail receipts that you have to show when your letter was received
  • Any texts you sent asking for texts to stop
  • Any documents confirming your request for calls/texts to stop

Wage Garnishment/Lawsuit Defense Help

  • the summons and complaint
  • the judgment if any has been entered against you
  • any garnishment paperwork provided to your employer or bank
  • any other documents related to the court file and/or judgment
  • all written correspondence you have from or sent to the debt collector or creditor
  • any certified mail receipts that you have to show when the debt collector or creditor received your dispute
  • any phone records (or written phone logs) you have showing any calls from the collector or creditor or at least pictures of your caller ID showing the collection calls you have received

Credit Report Help

  • complete copies of your credit reports (including the section marked “Inquiries”)
  • any dispute letters you have mailed to the credit reporting agencies regarding this matter
  • any certified mail receipts that you have to show when the credit bureaus received your dispute
  • investigation results from Trans Union, Equifax and/or Experian along with the complete copy of your credit report that was enclosed with your results
  • copies of any collection letters you have received
  • copies of any credit denial letters showing why you were turned down for financing, loan opportunities, etc.
  • any other documents you feel are relevant to, or support your case.

Unauthorized Withdrawals Help

  • any documents you signed when you authorized the withdrawals from your account
  • your monthly statements showing the electronic fund transfers from your account
  • any correspondence (including emails) between you and the person/business collecting the electronic payment
  • if applicable, copies of any contracts or membership agreements you signed with the person collecting the electronic payments.

Unfair Loan Practices Help

  • the original credit agreement including all attachments/ documents given to you at the time of signing
  • any electronic funds transfer authorizations you may have executed at the time you signed the credit agreement, please do so as soon as possible
  • If you were told you had to purchase any service or item to be approved for your loan, a brief statement explaining who told you this and when

Repossession Help

  • A written description of the facts surrounding the repossession, including things like where the car was repossessed from, whether you were present during the repo, whether there was a breach of the peace, etc.
  • Copies of the original credit agreement, including all attachments and other documents given to you at the time you signed the credit agreement.
  • Any phone records (or written phone logs) you have showing calls from anyone trying to collect the loan or repossess the vehicle.
  • All written correspondence you received from or sent to the creditor, repo company or debt collector about the vehicle.
  • Pictures of your caller ID showing the debt collection calls you have received with regard to the vehicle.
  • Any other relevant documents or information you feel you may have.

Home Mortgage Help

  • any written correspondence you have received from or sent to the servicer
  • copies of any documents you received prior to signing the loan agreement, including the application for credit;
  • copies of the original loan agreement and loan origination documents (including all attachments and other documents given to you at the time you signed the credit agreement)
  • copies of your monthly statements relating to the loan or a copy of the coupon book used to pay the loan if you do not receive monthly statements;
  • copies of escrow statements from loan servicer; and
  • if you have a mortgage loan on the home that was not used to purchase the home and is not the result of a refinance where you took no money out of the home, the two copies of the notice of right to rescind the transaction provided to you at the closing of the loan.
