My debt collection company agreed to accept three hundred dollars a month for 3 months as a payment plan. I agreed to allow them to take the money via electronic withdrawal on 3-29-06 and they did. They sent me a letter asking to withdraw another $300 on 4-30-06. I did not agree and called them to let them know there is not enough money in my account. They agreed to accept a money order instead. They just called my wife and told her they are going to put out a warrant for my arrest for a bad check. Can they do this?
Answer: First, never allow collectors access to your bank accounts!
Second, threatening to have you arrested for a “so-called” bad check is illegal and should be reported to your State Attorney general ASAP!There may be instances where discussing your situation over a public forum could potentially compromise your interests.
