A collection agency just pulled my credit bureau report for a cc debt that is 16 years old. The SOL has expired and the debt has been off my credit report for years. So, is it legal for this 3rd party collection agency to access my credit report?

Post-bankruptcy act aggression
My daughter lives in Georgia,she has a a credit card that was turned over to collections. The last date of activity on her credit report is 12-1999. The collection called her and threatened her and she told them she would pay. I told her to not pay this debt that the statute of limitation ran out for a judgement. Did I give her the right information?
So, two weeks ago I called Corporate Collections Service to reach a settlement for a debt I owed Dominion East Ohio Gas. After talking with the rep, she agreed to accept $1000 on the $1874 debt. She even verified with her manager that the settlement would be acceptable, and settled fully. Now, I called back after finding out they are still reporting the remainder as owed. They said, the rep was "new" and didn't know she couldn't accept a partial payment. After speaking with 2 others in the company, they refuse to clear the remainder. They admitted they had told me it would be acceptable, took my money, and now even though it's their wrong, I still owe the rest? Am I wrong in thinking they are unfairly representing my debt? Please help.

I had a judgement placed against me in 1999. I finally paid off the judgement in 2005 with the help of a credit counseling service. Now I am getting calls from a different collection agency claiming I owe more on the original account. They claim they sent a letter(s) to me stating the amouts owed, I never recieved any by mail. Now they are threating to sue for the amount due via phone. Is what they are doing legal? Can you be sued twice for the same debt? I disputed the debt in writing during the first 30 days of contact via phone.

My husband and I live in NC and were served a civil summons from a debtor collector lawyer representing the lender. The loan was for going to truck driver school it was called an education payment plan, Consumer Credit Installment Sale Contract. It stated on the contract the seller, which is The truck driving school intends to assigned the agreement to Student Finance Corporation in Newark,DE. Is this type of loan considered to be a student loan. The first payment was due in July 2001 and my husband hasn't never made a payment on this loan. I was a co-signer on the loan. I was wanting to used the SOL information I found on this site as our defense if this is not a student loan. We were served on 5/6/06 and have 30 days to respond. We call the collections office, who the account went to and offered to settle for 50% of the amount owed if they could send us the agreement in writing, but they refused. They wanted 75% of what's owed. Thanks in advance for any information you can give us on this matter.

I got letters from a dept collector and asked for validation on 4/21/06. They never validated the debt and they filed suit. I went to court but only their advocate showed up. I told her that I had requested validation but received none. She had no paper work but asked the clerk to continue the case. They gave them 90 days to validate the debt, is this legal?
