Alabama Fair Debt Collection Statute

§ 40-12-80. Collection agencies.
Each collection agency shall pay the following license tax: In towns and cities of 20,000 or more inhabitants, $100; in towns and cities of less than 20,000 inhabitants, $25. Each person who shall employ agents to solicit claims for collection from persons, firms, or corporations in the state shall be deemed a collection agency within the meaning of this section. This section shall not apply to any person who is excluded from the definition of the term “debt collector” under the federal Fair Debt Collection Practices Act, 15 U.S.C. § 1692a(6).

  1. i had a person call me today saying they were a para-legal for a lawyer out of GA. I live in AL. they said it was for a bad check written in july of 2006 they said i paid payments the last two were not paid and i needed to pay 350 today or they were going to sue for 850 on dec 29 first i dont remember it and second i would not have made payments i would have paid it in full with fee. is this legal or does it sound like a scam like i told the lady she was very rude and hostile

  2. I got a call saying that they had a returned check that I had written for $35 in 1999 and that I now owe them over $200 because it had say in a office from 1999 until now. That if it’s not paid within 24 hours they will garnish my wages. It’s 2016! Is this possible?

    • I got a similar phone call yesterday. They said I wrote a check in September of 1999 that was not honored and now I owe $197 for a $20 check. I tried to call the bank that I banked with back then to do some research but the bank has since been purchased and their records have been purged.

      I really think this is a scam. Can they even do this?

  3. There is an agency in New York that has been harassing my parents about getting in contact with me about a civil suit that a Thomas Shite has filed against me. They have been calling for MONTHS, but would not tell me who they were or what company they were with. They just wanted me to verify my personal information. When I refused, they got real agitated and demanded me give them my address. I told them that if I owed a debt, they should have my personal information and that I was not giving them anything over the phone. I did ask what information they had and they refused to tell me. So, I told them to stop calling my parents house. They have called before 8:00 in the morning and after 10:00 pm at times. The numbers that show up on caller ID are local numbers and they’re all different. I was finally able to call one number back to find out it is a company out of New York called RMS (Risk Management Services). After doing some research, they have treated A LOT of other people the same way. They find out what your relatives phone numbers are, as they did mine, and harass them at all hours. When I spoke to one guy, he refused to tell me what my debt was and starting this week, a guy named, ‘Eric’, is calling and saying that this ‘Thomas’ guy has filed a civil lawsuit against me. ‘Eric’ told my mother that they sent me something 45 days ago. However, I’ve never received ANYTHING from these people. According to what I’ve read in my research of consumer laws a debt collection, they are NOT to discuss ANYTHING with friends or family or anyone other than the person that supposedly owes the debt. What can I do about this company?

I got a call yesterday from an agency stating they were issuing a warrant for my arrest because Aaron’s furniture said I missed 4 payments (out of the 24 payments I made) back in 2012 for furniture. The guy called again and threatened to send the warrant forward if I didn’t pay. I spent the day yesterday trying to find my bank records ( I no longer have the same account) because I recall paying them completely. Because at the same time I was renting from Rent A Center (who sent email receipts) thus making it easier for me to keep track. I purchased both pieces at the same time and have an email trail showing RAC paid off but am still looking for paper receipts for Aarons. Can they send me to jail for 296.00 (is what he said I owe)?
